This study aimed to understand how intellectual protection strategies are being approached regarding traditional knowledge and Brazilian biodiversity, with a study of the historical, legal evolution and its applications. The new Biodiversity Law represents the new legal framework for Brazilian biodiversity and was implemented with the aim of reducing bureaucratic access to national genetic heritage and traditional knowledge. The work sought in bibliographic and documentary research to analyze national and international legislation related to the subject and demonstrate that the issue is still very incipient in Brazil. The study concludes that, as we are a country of continental dimension and with great cultural diversity, the treatment given by law to traditional communities should be used with a view to the specificities of each people.
